Terms of Use

Welcome to TestsPlatform! These Terms of Use ("Terms") govern your access to and use of the TestsPlatform website and services, accessible from https://testsplatform.com/ and https://app.testsplatform.com/.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Definitions

For the purposes of these Terms:

• Author - a registered user who creates tests on the platform.
• Applicant - a user who takes (passes) a test created by an Author.
• Test - a collection of questions created by an Author for assessment purposes.
• Assessment - the record of an Applicant completing a test, including their answers and results.
• Link - a URL through which a test is made available for Applicants to take.

2. Account Registration and Eligibility

To use certain features of TestsPlatform, you must create an account. By registering, you agree that:

• You are at least 16 years of age.
• You will provide accurate and complete registration information.
• You will maintain only one account per person.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You will notify us immediately at support@testsplatform.com if you suspect any unauthorized use of your account.

3. User-Generated Content

3.1 Ownership

Authors retain ownership of the original content they create on TestsPlatform, including tests, questions, and explanations. However, by publishing content on the platform, Authors grant TestsPlatform a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute their content through the platform for the purpose of providing and improving our services.

3.2 Author Representations

By creating and publishing content on TestsPlatform, Authors represent and warrant that:

• They have the right to publish the content and grant the license described above.
• The content does not infringe any third-party intellectual property rights.
• The content complies with our Content Guidelines (Section 4).
• They are solely responsible for the accuracy, quality, and legality of their content, including any AI-generated content they publish.

3.3 Public Display of Author Information

When you publish a test, the name you provide in your profile may be visible to Applicants who access your tests. You are not required to use your real name; you may use a pseudonym or business name. By publishing a test, you consent to displaying your chosen profile name to users who access your tests.

4. Content Guidelines (Acceptable Use Policy)

You agree not to create, upload, or share content that:

• Contains hate speech, discrimination, harassment, or bullying.
• Contains adult, sexual, or pornographic material.
• Promotes violence, threats, or self-harm.
• Encourages or provides instructions for illegal activities.
• Contains malware, phishing attempts, or other malicious content.
• Includes personal information of others without their consent.
• Infringes on copyrights, trademarks, or other intellectual property rights.
• Is misleading, fraudulent, or deceptive.
• Constitutes spam or unauthorized commercial advertising.

TestsPlatform reserves the right to remove content that violates these guidelines and to suspend or terminate accounts of users who repeatedly violate these terms.

5. Copyright and Intellectual Property

5.1 Respect for Intellectual Property

TestsPlatform respects the intellectual property rights of others and expects users to do the same. You may not upload, share, or publish content that infringes on the copyrights, trademarks, or other intellectual property rights of third parties.

5.2 Copyright Infringement Claims

If you believe that content on TestsPlatform infringes your copyright, please send a written notice to support@testsplatform.com containing:

• A description of the copyrighted work you claim has been infringed.
• The URL or location of the allegedly infringing content on our platform.
• Your contact information (name, email address, phone number).
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Upon receiving a valid notice, we will investigate the claim and take appropriate action, which may include removing the infringing content and notifying the user who posted it.

5.3 Repeat Infringers

TestsPlatform will terminate the accounts of users who are found to be repeat infringers of intellectual property rights.

6. Author Responsibilities for Applicant Data

Authors who collect data from Applicants through assessments (such as names, identifiers, or test results) agree to:

• Use applicant data only for the stated purpose of the assessment.
• Not sell applicant data to third parties.
• Not share applicant data with third parties except as necessary to fulfill the purpose of the assessment.
• Comply with applicable data protection laws, including GDPR and CCPA where applicable.
• Respond to data deletion requests from Applicants in a timely manner.

TestsPlatform provides tools for Authors to access assessment data. Once data is accessed by Authors, they become independent data controllers for that data and are responsible for its proper handling. TestsPlatform is not responsible for how Authors use applicant data after it is provided to them.

7. Account Deletion and Data Retention

You may delete your account at any time through your account settings or by contacting us.

7.1 For Authors

When an Author deletes their account:

• Their tests become unavailable for new assessments.
• Applicants who previously completed assessments can continue to view their results, including questions, their answers, and statistics, for historical reference.
• The Author's personal information is removed from these records.
• The test content remains visible to Applicants who completed it.

Authors who wish to have all test content removed (including from Applicant assessment history) may request this by contacting support@testsplatform.com. This may result in Applicants seeing only statistical results without question details.

7.2 For Applicants

Applicants may request deletion of their assessment data by contacting support@testsplatform.com. We will process such requests in accordance with applicable data protection laws.

8. Subscription Plans and Payments

8.1 Plans

TestsPlatform offers both free and paid subscription plans:

8.2 Billing

• Paid subscriptions are billed on a recurring monthly basis.
• Payment is processed through Stripe, our third-party payment processor.
• By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

8.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. After that, your account will revert to the Free plan.

8.4 Refunds

Refund requests are considered on a case-by-case basis. To request a refund, contact support@testsplatform.com within 14 days of the charge. We do not provide refunds for partial months of service.

9. AI-Powered Features

TestsPlatform includes AI-powered features provided by OpenAI, including:

• AI Assistant for generating questions and test content.
• AI review of free-form answers.
• Test generation from uploaded files.
• AI-generated explanations for questions.

By using AI features, you acknowledge and agree that:

• Your input (including test content, questions, and chat messages) is sent to OpenAI for processing.
• AI-generated content should be reviewed for accuracy before publishing.
• You remain solely responsible for all content you publish, including AI-generated content.
• You can choose not to use AI features if you prefer not to share data with OpenAI.

10. Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other users' accounts or to our systems or networks.
• Interfere with or disrupt the service or servers or networks connected to the service.
• Use automated means (bots, scrapers, etc.) to access the service without our prior written consent.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the service to send spam or unsolicited communications.
• Circumvent, disable, or otherwise interfere with security-related features of the service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TestsPlatform does not warrant that:

• The service will be uninterrupted, secure, or error-free.
• The results obtained from the service will be accurate or reliable.
• Any errors in the service will be corrected.

Assessment results are provided for informational purposes only. TestsPlatform is not responsible for any decisions (hiring, educational, or otherwise) made based on assessment results.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TESTSPLATFORM AND ITS EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL TESTSPLATFORM'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID TO TESTSPLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless TestsPlatform and its employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the service.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you create, upload, or share through the service.

14. Termination

We may suspend or terminate your access to the service at any time, with or without cause, including for:

• Violation of these Terms or our Content Guidelines.
• Fraudulent, illegal, or abusive activity.
• Non-payment of applicable fees.
• Extended account inactivity.
• Requests by law enforcement or government agencies.

Upon termination:

• Your access to the account will be revoked.
• Your data will be handled in accordance with our Privacy Policy and Section 7 of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (sent to the email address associated with your account) and/or by posting a notice on our website prior to the changes becoming effective.

Your continued use of the service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you should stop using the service and delete your account.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TestsPlatform is registered, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the service shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration or the courts of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TestsPlatform regarding the use of the service.
